JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-01-2021 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in connection with Bettiah (T) P.S. Case No. 759/2019 for the offence under Sections 406 and 504 IPC and 138 NI Act.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The instant case arises out of dishonour of cheque which has been purportedly issued for commercial activities.
Considering the fact that the case arises out of dishonour of cheque, the court is inclined to grant bail to the petitioner. Let the petitioner, above named, in the event of arrest or surrender before the court below within a period of four
Patna High Court CR. MISC. No.28485 of 2020(2) dt.19-01-2021 2/2 weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the CJM, West Champaran, Bettiah in connection with Bettiah (T) P.S. Case No. 759 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
