2. As prayed, the writ petition is permitted to be withdrawn and dismissed with the aforesaid liberty.
3. It is made clear that in case such an appeal is filed, the appellate authority would have regard to the present proceeding being pursued by the petitioner while considering the question of condonation of delay.
