The petitioner apprehends his arrest in connection with Rajapakar P.S. Case no. 87 of 2012, registered under Sections 302, 307, 379, 325, 338, 337, 323, 341, 147, 148 and 149 of the Indian Penal Code.

The allegation of informant/deceased Mithilesh Prasad Singh is that on 24.04.2012, he had gone to village Sapaha Dayalpur along with his trolly for participate in the marriage ceremony, which has been hired by Rama Shankar Pandit on the occasion of marriage of his son. Thereafter, informant made demand of charges of the trolly set then Rama Shankar Pandit asked him to board in Bolero vehicle and money will be paid in the way. Thereafter, informant and his labourer boarded in the vehicle, when Bolero reached at Bidupur then informant again made demand of charges of his trolly to Rama

Patna High Court Cr.Misc. No.53418 of 2016 (6) dt.19-07-2017 2/2 Shankar Pandit then he along with his son-in-law (Petitioner) dashed him to the vehicle and started to cause assault. At that time, Rama Shankar Pandit caused injury at his mouth left hand and chest. Thereafter, informant was rushed to the hospital for treatment, where he died.

Learned counsel for the petitioner submits that admittedly, the petitioner is the son-in-law of Rama Shankar Pandit and he had gone to attend the marriage ceremony of his brother-in-law and he was present in the said vehicle due to that reason, he has been implicated in this case. Further submission is that informant clearly stated about causing injury to him by Rama Shankar Pandit. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Rajapakar P.S. Case No. 87 of 2012, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
