The petitioner is apprehending arrest in connection with Chiraiya (Shikarganj) P.S. Case No. 97 of 2020 for offences under Sections 272,273 IPC and 30(a) of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case 9 liters of liquor was seized but nothing was seized from the conscious possession of this petitioner.
Considering the fact that the petitioner has no criminal antecedent and nothing was recovered from the constructive possession of the petitioner, the Court is inclined to grant bail to the petitioner on deposit of cash of Rs. 10,000/-. Let the

No.28421 of 2020(2) dt.18-01-2021 2/2 petitioner, above named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Motihari, East Chamapran in connection with Chiraiya (Shikarganj) P.S. Case No. 97 of 2020, subject to deposit of cash of Rs. 10,000/- and further subject to the conditions as laid down under Section 438(2) Cr. P. C.
The deposit of cash of Rs. 10,000/- shall abide by the final outcome of the present criminal case.
