The petitioner has preferred this application for grant of regular bail in a case registered under section 25(1-B)(a), 26 and 35 of the Arms Act and 67 of the I.T. Act. As per the prosecution case, on search by the police, one loaded Nalkatua was recovered from the possession of the petitioner who was apprehended by the police after receiving a viral video and a photograph of the petitioner in which he and the co-accused were holding Nalkatua and the petitioner was
Patna High Court CR. MISC. No.27950 of 2022(3) dt.15-09-2022 2/2 also firing from his pistol.
Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 14.02.2022.
Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case as well as the period of detention, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below, East Champaran in connection with Sugauli P.S. Case No. 88 of 2022.
The application stands allowed.
