Petitioner claims to have retired from the post of Assistant Engineer Incharge on 31.1.2013 from the office of Zila Parishad, Vaishali.

It is contended that except group insurance amount nothing out of the post retrial benefits, to which the petitioner is entitled, has been paid till date.

Accordingly, this writ application is being disposed of with a direction to the respondent no. 5, Deputy Development

Patna High Court CWJC No.1838 of 2016 dt.20-05-2016 2/2 commissioner-cum-Chief Executive Officer, Zila Parishad, Vaishali to calculate the admissible amount of the petitioner with respect to all the heads of the retiral benefits and ensure payment of the same along with statutory interest, if any, within a period of two months from the date of receipt / production of a copy of this order. So far the provident fund amount of the petitioner is concerned, it is directed to be paid forthwith along with statutory interest upon production of a copy of this order.

It is made clear that if the claim of the petitioner is not found tenable then a reasoned order would be required to be passed by the respondent no. 5, which should be communicated to the petitioner immediately.
