JUSTICE RANA VIKRAM SINGH ORAL ORDER 29-07-2026 Mr. Vinay Kumar Mishra, learned counsel for the petitioner, at the very outset, prays for withdrawal of the application on the ground that it has become infructuous.
2. Mr. Udeshya Kumar Yadav, learned counsel appearing on behalf of O.P. No. 2, submits that the order taking cognizance, passed in the year 2016, is under challenge.
3. Mr. Manoj Kumar Srivastava, learned Additional Public Prosecutor for the State, is present.
4. The prayer made on behalf of the petitioner is allowed.
5. Accordingly, this application is disposed of as
Patna High Court CR. MISC. No.52316 of 2016(4) dt.29-07-2026 2/2 withdrawn, with liberty to the petitioner to file an appropriate application before the learned Trial Court, if the case still survives, raising all the grounds and defences that have been taken in the present application. If such an application is filed, the learned Trial Court shall consider and dispose of the same by a reasoned and speaking order, without being prejudiced by this order of this Court, as this Court has not expressed any opinion on the merits of the case.
