The petitioner seeks bail in anticipation of his arrest in connection with Rajnagar P.S. Case No. 132 of 2015 dated 09.07.2015 instituted for the offences under Sections 341, 323, 325, 307, 504 and 506/34 of the Indian Penal Code.

The petitioner and others are said to have entered the house of the informant and two other coaccused persons viz. Kanhaiya Choudhary and Sanjay Choudhary are said to have assaulted the informant by means of hard and blunt substances leading to injuries. One of the other accused persons is said to have taken away money from the house of the informant.

Learned counsel for the petitioner has

Patna High Court Cr.Misc. No.21426 of 2018(2) dt.26-04-2018 2/2 submitted that but for the petitioner being named in the FIR, no other allegation has been levelled against him. The petitioner is a close agnate of the informant and has only been made accused in this case because he is a sympathizer of the person with whom the informant is having some dispute. The cause as well as the genesis of the occurrence also have not been stated in the FIR. The petitioner does not have any criminal antecedent.

For the facts stated above, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class, Madhubani in connection with Rajnagar P.S. Case No. 132 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
