2. With the consent of both the parties, this writ application is being disposed of at the present stage itself.

3. Learned counsel for the petitioner submits that for the relief as claimed for in the present writ application, the petitioner has already filed a representation before the

Patna High Court CWJC No.7866 of 2025(2) dt.10-07-2025 2/3 Government of Bihar, Patna, which is dated 10.05.2024 (Annexure-P/5) which is still pending. Learned counsel for the petitioner further submits that he would be satisfied, if an appropriate direction could be issued by this Court directing the Government of Bihar, Patna to dispose of the representation of the petitioner on merit after giving an opportunity of hearing to the petitioner, by passing a reasoned and speaking order.

4. The aforesaid prayer made by learned counsel for the petitioner is not opposed by the other side. However, the learned counsel appearing for respondents-State has raised serious question with regard to the locus of the petitioner to maintain this writ application. This issue will remain open to be decided by the Additional Chief Secretary, Panchayat Raj Department, Government of Bihar, Patna, while disposing of the representation.

Considering the limited nature of prayer being made by learned counsel for the petitioner, this writ application is disposed of directing the Additional Chief Secretary, Panchayat Raj Department, Government of Bihar, Patna, to dispose of the representation of the petitioner dated 10.05.2025 (Annexure-P/5) after giving an opportunity of hearing to the

Patna High Court CWJC No.7866 of 2025(2) dt.10-07-2025 3/3 petitioner, by passing a reasoned and speaking order.

6. The entire exercise must be completed by the Government of Bihar, Patna within a period of three months from the date of production of a copy of this order by the petitioner. It is once again reiterated that the locus of the petitioner to agitate these kind of issues will be open for adjudication by the Additional Chief Secretary, Panchayat Raj Department, Government of Bihar, Patna.

7. With the aforesaid observation and direction, the present writ application is disposed of. All pending I.As, if any shall be deemed to have been disposed of.
