Heard learned counsel for the petitioner and learned AC to SC-21.

Learned counsel for the petitioner submits that the instant writ application has been filed for quashing the settlement order (Parwana) issued in favour of the private respondent No. 8 by the respondent No. 4 with regard to pond appertaining to Khata No. 127, Khesras No. 70, Area-113.5 decimal at Mauza- Nonesar, Thana No. 83, Circle-Sultanganj, District- Bhagalpur.

The learned counsel for the petitioner next submits that the land in dispute is having Jamabandi No. 208, which was

Patna High Court CWJC No.7695 of 2025(2) dt.28-07-2025 2/2 created in the name of Ramrati Devi, wife of late Indradeo Singh, based on a decree passed in T.S. No. 179 of 1976 instituted under Section 106 of the Bihar Tenancy Act by Indradeo Singh (husband of Ramrati Devi). It is further submitted that daughter of Ramrati Devi, who was the sole legal heir of Indradeo Singh and Ramrati Devi, in the year 2014 had executed a registered will in favour of the petitioner at Bhagalpur Registry. Learned counsel thus submits that based on the registered will of the land in dispute executed in favour of the petitioner by the sole legal heir of Indradeo Singh and Ramrati Devi, the petitioner is assailing the settlement made in favour of respondent No. 8.

Learned counsel for the petitioner, after arguing for some time realising his difficulty, seeks permission to withdraw the writ application with liberty to the petitioner to avail her remedy in accordance with law before an appropriate forum. 5.

Permission is accorded.

Accordingly, the instant writ application is dismissed as withdrawn with the liberty aforesaid. (Satyavrat Verma, J) Sumit/- U
