The petitioner apprehends his arrest in Sherghati (Dobhi) P.S. Case No. 138 of 2015 registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.

The informant, son of the deceased, lodged the case after recovery of dead body of his father in the forest area and suspected that his father was killed by Kishun Yadav and others including the petitioner and they threw the dead body in the forest. Learned counsel for the petitioner submits that there is no witness of the occurrence and on mere suspicion name of the petitioner is mentioned in the FIR.

Learned APP did not dispute the facts.

No.41279 of 2016 (3) dt.19-11-2016 2/2 Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Sherghati, Gaya in Sherghati (Dobhi) P.S. Case No. 138 of 2015, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
