The petitioner apprehends his arrest in connection with Amarpur P. S. Case No. 306 of 2017 instituted under Section 135 of the Electricity Act.
It is submitted that FIR itself reveals that no any electricity theft was being committed rather there was outstanding dues with the Electricity Supply Division and there is no any seizurelist showing any theft of electricity. Learned counsel for the South Bihar Power Distribution Limited opposed the prayer for bail. Having considered the aforesaid facts and circumstances, let the petitioner, namely, Soud @ Saud Khan, in
Patna High Court Cr.Misc. No.52851 of 2017 (2) dt.09-11-2017 2/2 the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S.Case No. 306 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
