JUSTICE RAMESH KUMAR DATTA ORAL ORDER 24-08-2016 Heard learned counsel for the petitioner and learned counsel for the Bihar State Food and Civil Supplies Corporation. The modification petition has been filed for modifying the interim order dated 17.06.2014 passed by this Court in C.W.J.C. No.9753 of 2014, by which the petitioner had undertaken to deposit an amount of Rs.13 Lacs, 50% of the said amount within a week from the date of the order and the balance 50% within four weeks.
It is submitted by learned counsel for the petitioner that on account of hardship the petitioner could deposit only first instalment within time and the deposit of the second instalment has been delayed to 08.02.2016 and 03.06.2016 when amounts of Rs.1,50,000/- and Rs.5,00,000/- were respectively deposited. Patna High Court MJC No.2513 of 2014 (2) dt.24-08-2016 application itself has been disposed of and the matter has become infructuous but he does not have any objection to the extension of time since the deposits have already been made. In the above circumstances, the time for deposit of the balance amounts of Rs.6,50,000/- is extended to the dates on which they were actually deposited.
