ANJANA MISHRA ORAL ORDER 13-01-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Belaganj P.S. Case No.242 of 2016 for allegedly having committed the offence under Sections 406, 420 of the Indian Penal Code and Section 7 of the Essential Commodities Act.
Learned counsel for the petitioner submits that the petitioner has purchased the rice from the farmers and the allegation of recovery of rice from his godown is wholly frivolous.
Considering the nature of allegations made and that the petitioner has purchased such rice from the farmers, let the
Patna High Court Cr.Misc. No.54748 of 2016 (2) dt.13-01-2017 2/2 petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-XI, Gaya, in connection with Belaganj P.S. Case No.242 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
