JUSTICE RAKESH KUMAR ORAL ORDER 20-01-2016 Heard Sri Binod Murari Mishra, learned counsel for the petitioner and Sri Rajeev Kumar Verma, learned senior counsel, who was assisted by Sri Prashant Sinha, learned counsel for the opposite parties/ officials of the Regional Provident Fund Commissioner.

The present petition has been filed with a prayer to restore CWJC No. 14368 of 2013, which stood dismissed on 28.9.2015 due to non prosecution.

Learned counsel for the petitioner submits that the ground set forth in the petition is sufficient for allowing the restoration petition, whereas, learned senior counsel for the opposite parties has vehemently opposed the prayer for restoration.

In view of the facts and circumstances, the court is

Patna High Court MJC No.3348 of 2015 (2) dt.20-01-2016 2/2 satisfied with the reasons assigned in the petition. Accordingly, the restoration petition stands allowed.

Let CWJC No. 14368 of 2013 be restored to its original file.
