The petitioner apprehends her arrest in a case registered for offences punishable under Sections 363/366A/34 of the Indian Penal Code.
It is contended on behalf of the petitioner that the name of the petitioner has been taken only on the basis of suspicion that she may have a role in the kidnapping of the daughter of the informant. However, in Section 164 Cr.P.C. statement the girl has not alleged anything against the petitioner and all other accused persons have been granted anticipatory bail vide Annexure 3 series. Petitioner is a lady. Having regard to the facts and circumstances of the case,
Patna High Court Cr.Misc. No.37890 of 2016 (2) dt.22-09-2016 2/2 let the above named petitioner be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Mahua P.S. Case No. 530 of 2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
