The petitioner is in custody in connection with Udakishunganj P.S. Case No. 358 of 2019 for the offences under Sections 341, 323, 324, 504, 354, 302/34 of the Indian Penal Code.

On account of scuffle between the informant and her agnates, it is alleged that this petitioner dashed ten months old baby of the informant on the ground who during course of treatment died.

Learned counsel appearing on behalf of the petitioner would submit that the F.I.R was lodged for the offence under Sections 302/34 and other provisions of the Indian Penal Code but the police after investigation

Patna High Court CR. MISC. No.24833 of 2020(3) dt.04-01-2021 2/2 has submitted charge-sheet under Sections 341, 323, 504, 354, 304/34 of the Indian Penal Code.

The petitioner is in custody since 12.03.2020 and he has no criminal antecedent.

Considering the fact that the petitioner is not having any criminal antecedent and the charge-sheet has been submitted under Sections 341, 323, 504, 354, 304/34 of the Indian Penal Code, this Court is inclined to grant bail to him.

The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Uda-Kishunganj, Madhepura in connection with Udakishunganj P.S. Case No. 358 of 2019.
