After some arguments, learned counsel for the petitioner seeks permission to withdraw this modification petition which has been filed for extension of time to surrender of the petitioner in pursuance of the order dated 13.10.2015 passed in Cr. Misc. No. 44496 of o2015. Prayer is allowed.

The petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail, his prayer shall be considered on its own merit without being prejudiced by this order and taking into consideration that the petitioner did not surrender in time but he has been granted anticipatory bail and dispose of the bail petition preferably on the same day.

The petition stands dismissed as withdrawn.
