JUSTICE PARTHA SARTHY ORAL ORDER 14-12-2020 Heard learned counsel for the petitioner and learned APP for the State, through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Phulwarisharif P.S. Case No. 1049 of 2019 registered against unknown under section 395 of the Indian Penal Code.

As per allegation in the FIR, 7-8 accused persons broke open the door of the house of the informant, tied them up and took away ornaments etc. worth Rs. 5 lakhs. It is submitted by learned counsel for the petitioner that the name of the petitioner transpired in confessional statement of a co-accused Harun Kumar in one another case. It is submitted that the alleged confessional statement made before the police has no value. No incriminating article has been

Patna High Court CR. MISC. No.28235 of 2020(3) dt.14-12-2020 2/2 recovered from the possession of the petitioner nor has he been put on T.I. parade. He is in custody since 18.2.2020 and investigation in the case with respect to him has concluded. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and in view of the submissions made on behalf of the petitioner together with the petitioner being in jail since 18.2.2020 and not having put on T.I. parade, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Phulwarisharif P.S. Case No. 1049 of 2019 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, IX, Patna.
