2. The petitioner seeks regular bail in connection with Ismailpur P.S. Case No. 121 of 2022 registered for the offence under Sections 363, 366A/34 of the Indian Penal Code but the charge sheet has been submitted under Sections 366, 366A, 376 of the IPC and Section 4 of the POCSO Act.

3. As per the prosecution case, the petitioner is accused of kidnapping the victim girl.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. Petitioner is in custody since 03.09.2024.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Though the petitioner is accused of kidnapping the victim girl but from the statement of the victim girl recorded under Section 164 Cr.P.C., it appears that the petitioner and victim have got married.

7. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned concerned Court below, Bhagalpur in connection with Ismailpur P.S.
