Petitioner apprehends his arrest in connection with Biraul P.S. Case No. 317 of 2016 registered for the offences punishable under Sections 341, 323, 324, 308, 504, 506 and 379/34 of the Indian Penal Code.

Allegation against the petitioner is of assault by knife to the informant, causing injury.

Submission of learned counsel for the petitioner is that the title suits are going on between the parties and there is case and counter case and persons from petitioner's side have also received injuries, some of which are grievous. Heard learned APP and learned counsel for the informant. They have opposed the prayer for anticipatory bail of

Patna High Court Cr.Misc. No.20683 of 2018 (2) dt.26-04-2018 2/2 the petitioner on the ground that there is allegation of stabbing against the petitioner and injury is said to be grievous in nature. Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit without prejudiced by the order of this court.
