JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-04-2018 The petitioners seek bail in anticipation of their arrest in connection with Complaint Case No. 3051 of 2015 in which cognizance has been taken under Sections 420, 467, 468 and 471/34 of the Indian Penal Code.
A land which was purchased by the father of the complainant/opposite party No. 2 was sought to be sold to some other person at the instance of Gulam Mushtafa @
Patna High Court Cr.Misc. No.21449 of 2018 (2) dt.26-04-2018 2/2 Mushtaq. The petitioners are the deed-writer and the witness respectively to the aforesaid document, whereby the land has been transferred in favour of aforesaid Gulam Mushtafa @ Mushtaq.
Learned counsel for the petitioners has submitted that but for dispensing with their professional work, the petitioners have not done anything for them to be prosecuted in the present case.
Considering the fact that the petitioners are the deed-writer and the witness to the document in question respectively, this Court is inclined to enlarge them on anticipatory bail.
Let the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Complaint Case No. 3051 of 2015.
