JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-07-2019 This is an application for grant of anticipatory bail in connection with Chainpur P.S. Case No.215 of 2018, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Written report disclosed that police on checking was intercepted a motorcycle and recovered 48 bottles of 180 ml each of foreign liquor from the said motorcycle and later on, it transpires that the motorcycle belongs to the petitioner. Petitioner is not named in the F.I.R.

Submission of the learned counsel for the petitioner is that on the same day, he has lodged an information to police station Bhagwanpur, which will appear from the Annexure A and now he has falsely been implicated in this case. He has no criminal antecedent.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge, IV-cum-Special Judge Excise, Kaimpur at Bhabua, in connection with Chainpur P.S.
