JUSTICE SUDHIR SINGH ORAL ORDER 24-11-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioners are apprehending their arrest in connection with RPF Jamalpur Workshop Case No. 03 of 2015 for the offence instituted under Section 3 (a) RP(UP) Act. The allegation against the petitioners is that they are also said to have involved in stealing of certain railway properties.

It has been submitted on behalf of the petitioners that the petitioners have falsely been implicated in the present case. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are ladies. They have been made

Patna High Court Cr.Misc. No.50320 of 2016 (2) dt.24-11-2016 2/2 accused in the F.I.R. only on the basis of disclosure made by coaccused namely Ambika Prasad Singh. No railway property has been recovered from the conscious possession of the petitioners. On behalf of the State, it has been submitted that the petitioners are named in the prosecution report. Considering the aforesaid facts and circumstances, let the petitioners above named be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with RPF Jamalpur Workshop Case No. 03 of 2015 on furnishing bail bonds of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Kiul subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
