JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 01-05-2018 The sole appellant namely, Rajendra Sharma, son of Late Musafir Singh has filed this appeal challenging his conviction order passed by learned Additional Sessions Judge - IInd, Patna in Sessions Trial No. 197/90 for offences under Section 302, 302/34, 307/34 of the Indian Penal code and 27 of the Arms Act on 14.09.1993 and sentenced him to undergo rigorous imprisonment for life under Section 307 of the Indian Penal Code, 5 years under Section 307 of the I.P.C. and three years for offences under Section 27 of the Arms Act.

During pendency of this matter, a supplementary affidavit has been filed on 06.11.2017 which goes to show that the sole appellant Rajendra Sharma has expired on 01.10.2017 and the death certificate Annexure-1 has been produced which indicates

Patna High Court CR. APP (DB) No.504 of 1993 (10) dt.01-05-2018 that the sole appellant has died. That apart, the Mukhiya of the Gram Panchayat has also issued a certificate to that effect. Keeping in view the aforesaid, the appeal so far as it pertains to the present appellant Rajendra Sharma stands disposed of as abated.
