Petitioners apprehend their arrest in connection with Bishanpur P.S. Case No. 82 of 2017 registered for the offences punishable under Sections 365 and 366 of the Indian Penal Code. Allegation against the petitioners is of kidnapping the minor daughter of the informant.
Submission of learned counsel for the petitioners is that the victim girl disclosed her age as eighteen years in her statement under Section 164 of Code of Criminal Procedure and moreover she has not supported the prosecution case, rather stated that she married with the petitioner No. 1 on her own sweet will and the girl has also been released in favor of the father of the petitioner. Heard learned APP also.

No.20882 of 2018 (2) dt.26-04-2018 2/2 Having heard both sides and in the facts and circumstances, let petitioners, in the event of their arrest or surrender be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VII, Darbhanga, in connection with Bishanpur P.S. Case No. 82 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court.
