The petitioner apprehends his arrest in connection with Karjain P.S. Case No. 03 of 2017, registered for the offence punishable under Section 366/34 of the Indian Penal Code. Allegedly, on 28.12.2016 the grand-daughter of the informant had gone to attend the call of nature thereafter she did not return back, on search no trace was found. The informant raised suspicion about kidnapping for grand-daughter by Mukesh Kumar with the help of the petitioner and his wife with intention to perform the marriage.
Submission is of false implication and that it would appear from the F.I.R. that there was love affair in between the
Patna High Court Cr.Misc. No.50484 of 2017 (3) dt.14-12-2017 2/2 grand-daughter of the informant and co-accused Mukesh Kumar and she left the village with Mukesh Kumar according to her own sweet will but with ulterior motive the petitioner who is the father of Mukesh Kumar has falsely been implicated in this case. The two co-accused namely, Kamal Mehta and Lakshmi Devi have been allowed pre-arrest bail by another co-ordinate benches of this Court vide Annexure 2 series.
The learned A.P.P. fairly submits that two co-accused have been allowed pre-arrest bail.
In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri A.K. Pandey, learned J.M., Birpur (Supaul), in connection with Karjain P.S. Case No. 03 of 2017, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.)
