The petitioner apprehends his arrest in a case registered for the offences punishable under Section 363 of the Indian Penal Code.
Unmarried daughter of the informant went missing on the way to her school.
Learned counsel for the petitioner submitted that no such occurrence as alleged ever took place. The petitioner is quite innocent and has been falsely implicated in this case merely on suspicion. He has no concern with the said occurrence. He has not been named in the F.I.R. He has not kidnapped the victim. The victim in her statement recorded
Patna High Court CR. MISC. No.30430 of 2019(2) dt.08-05-2019 2/2 under Section 164 Cr.P.C. has not stated about her kidnapping by the petitioner rather has stated that she has suo motu left for her aunt at Mugalsarai and went to Varanasi for roaming. No one has kidnapped her. Petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Kaimur at Bhabua in connection with Chainpur P.S. Case No.366 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
