Patna High Court Cr.Misc. No.40619 of 2016 (2) dt.22-09-2016 2/3 This application, for grant of anticipatory bail, arises out of Baheri P.S. Case No. 116 of 2016, disclosing offences under Sections 447, 341, 323, 504, 307, 354 and 325/34 of the Indian Penal Code.

From the First Information Report, it transpires that occurrence took place over land dispute between the parties. It also appears that injuries, allegedly caused, cannot be said to be grievous in nature. Though, the petitioners have criminal antecedent, I am inclined to grant them the privilege of anticipatory bail in the background of nature of allegation made against them. This application is, accordingly, allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Darbhanga, in connection with Baheri P.S. Case No. 116 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners, above named, shall present themselves before the police/Court, as the case may be, as and when
