Petitioner seeks bail in Ara Muffasil P.S. Case No.133 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act.
The informant got inputs that the petitioner brought consignment of liquor and he was getting the liquor packaged. When the informant reached to the mango orchard of the petitioner, two persons started fleeing away but on chase Mahashankar Paswan was apprehended and he disclosed that Vishal Singh (petitioner) managed to flee away. Mahashankar Paswan further disclosed that he is a labour, who was packaging the liquor on the order of Vishal Singh (petitioner). The police recovered 120 litres of country made liquor kept in the plastic bag under the earth.
Patna High Court CR. MISC. No.25211 of 2020(2) dt.28-09-2020 2/2 Learned counsel for the petitioner submits that the petitioner has got one criminal case, which is registered under the Arms Act. The petitioner is in jail since 15.05.2020 for recovery of 120 litres of country made liquor. Taking into consideration the facts aforesaid and the fact that the petitioner has already remained in jail for about four and half months for recovery of 120 litres of country made liquor, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned 4th Additional Sessions Judge-cum-Special Judge, Excise, Ara, Bhojpur in connection with Excise Case No.678 of 2020 arising out of Ara Muffasil P.S.
