The present application has been filed for recall of the order dated 04.10.2016 passed in Cr. Misc. No. 43898 of 2016, by which the case was dismissed for non prosecution. Upon hearing learned counsel for the parties, the Court finds that sufficient cause has been shown for non appearance of learned counsel for the petitioner on 04.10.2016 due to which the case was dismissed.

Accordingly, the order dated 04.10.2016 passed in

Patna High Court Cr.Misc. No.50949 of 2016 dt.11-01-2017 2/2 Cr. Misc. No. 43898 of 2016 stands recalled. The case is restored to its original file and number.

The application stands disposed off.
