The petitioners apprehend their arrest in connection with Kako P.S. Case No. 169 of 2017 instituted for the offences punishable under Sections 341, 323, 504 and 307/34 of the Indian Penal Code.
It appears that altogether seven persons assaulted the informant. The allegation of assault by iron rod is against Rajesh Kumar. The allegation against these petitioners appears omnibus. The injury report, which has been annexed as Annexure-3 of this application shows that the informant sustained multiple lacerated
Patna High Court Cr.Misc. No.50364 of 2017 (2) dt.30-10-2017 2/2 wound on skull with bleeding, which is attributed against Rajesh Kumar. There is also a counter case bearing Kako P.S. Case No. 170 of 2017.
The learned A.P.P. for the State, on the other hand, opposed the submission.
Considering the nature of allegation, facts and circumstances of the case, the anticipatory bail prayer is allowed. The petitioners, above named, in the event of arrest / surrender within six weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Jehanabad in connection with Kako P.S. Case No. 169 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Sanjay Kumar, J) ajay gupta/- U T
