JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-10-2020 The present petition has been taken up for consideration through the mode of Video Conferencing in view of the prevailing situation on account of COVID-19 Pandemic. Heard the learned counsel for the petitioner and Sri Ashok Kumar, the learned A.P.P. for the State. This is an application for grant of anticipatory bail in connection with Tharthari PS case no. 136 of 2019 registered for the offences punishable under Sections 307 and other allied sections of Indian Penal Code.
The allegation is regarding the petitioner having cut the ear of the son of the informant by a sharp edged weapon resulting in him being inflicted with grievous injury and when the informant had gone to save his son, the petitioner had also assaulted him.

No.23964 of 2020(2) dt.09-10-2020 2/2 The learned counsel for the petitioner has submitted that the petitioner is innocent, has been falsely implicated in the present case and is having a clean antecedent. It is further submitted that the petitioner has compromised the matter with the accused persons, hence this Court may take sympathetic view in this matter.
Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the fact that the injury sustained by the injured person, attributable to the petitioner herein, is serious in nature, I do not find the present case to a fit case for grant of anticipatory bail, hence the present petition stands dismissed.
