1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 363, 364, 372, 365, 366(A)/34 of the Indian Penal Code and 3⁄4 of POCSO Act.

3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that accused persons including the petitioner kidnapped her minor daughter.

4. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is next submitted that the victim has come back and statement was recorded under Section 164 Cr.P.C. wherein she has not

Patna High Court CR. MISC. No.28522 of 2023(2) dt.25-07-2023 2/2 supported the case of the prosecution, as would be evident from Annexure-2 to the anticipatory bail application.

5. Learned A.P.P. opposes the bail application.

6. Consideration the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below withing a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge VIth-cumSpecial Judge (POCSO) in connection with Vijaypur P.S. Case No. 07 of 2022, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The applications stands allowed.
