2. The petitioner seeks bail in connection with Garkha P.S. Case No. 549 of 2018 registered for the offence under Sections 304(B)/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is the husband of the deceased and he is said to have killed his wife for demand of dowry.

4. The petitioner is in custody since 18.02.2025.

5. Learned counsel for the petitioner submits that the petitioner is innocent and he was not even present at the place when the incident took place. He further submits that the deceased was ill and for better treatment she was referred to another hospital but on the way to the said hospital, she died. He

Patna High Court CR. MISC. No.30394 of 2025(4) dt.17-10-2025 2/2 also submits that in the trial, charges have not been framed yet.

6. Considering the aforesaid facts and also considering the period of custody of the petitioner, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-XIV, Saran at Chhapra/concerned Court below in connection with Garkha P.S. Case No. 549 of 2018. (Sandeep Kumar, J) Vikas/- U
