This application for grant of anticipatory bail arises out of Bhagwanbazar P.S. Case No. 184 of 2016, disclosing offences under Sections 302/34 of the Indian Penal Code. Petitioner No. 1 is the wife of brother of the husband of the deceased whereas petitioner No. 2 is the brother of the husband of the deceased. Petitioner No. 3 is the mother-in-law of the deceased. It is alleged in the First Information Report by the informant that his daughter was married to accused Manoj Prasad nearly 10 years ago His son-in-law was having illicit relationship with petitioner No. 1 because of which, he used to torture the deceased and a complaint to this effect was made to Gandhi Maidan Police Station in the year 2015.
Considering the fact that the petitioners No. 1 and 3 are
Patna High Court Cr.Misc. No.41012 of 2016 (2) dt.27-09-2016 2/2 ladies and there is no specific allegation against the petitioner No. 2 and the submissions as above, this application is allowed. Let the petitioners, above-named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Bhagwanbazar P.S. Case No. 184 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
