Petitioners seek bail in Brahmpur P.S. Case No.488 of 2018 instituted for the offence under Section(s) 30(a), 47 of Bihar Prohibition and Excise Act, 2018.

Counsel for the petitioners submits that two persons were apprehended by the police, who disclosed their names as Vikas Kumar and Mulayan Yadav. They disclosed the name of these petitioners.

Petitioners are in custody since 26.03.2019.

Counsel for the petitioner further submits that coaccused, Vikash Kumar and Mulayan Yadav, have already been

Patna High Court CR. MISC. No.27572 of 2019(2) dt.29-04-2019 2/2 granted regular bail by co-ordinate Bench of this Court by order dated 21.12.2018 passed in Cr. Misc. No.76420 of 2018. In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the ADJ II cum Special Judge, Excise Act, Buxar, in connection with Brahmpur P.S. Case No.488 of 2018, subject to the condition that both the bailors shall be close relative of the petitioners. It appears that one more case under the Excise Act is pending against the petitioners. The petitioners will file an Affidavit at the time of their furnishing bail bonds that they will not indulge in such activities in future, otherwise, their bail bonds in the instant case will liable to be cancelled.
