1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code.
3. The informant alleges that accused persons came and Guddu assaulted his brother by an iron rod who became unconscious.
4. Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and petitioner No.
Patna High Court CR. MISC. No.30136 of 2023(2) dt.26-07-2023 2/2 2, 3 and 4 are women.
5. Learned counsel for the petitioners submits that from bare perusal of the allegations as alleged in the FIR, it would manifest that specific allegation of assault is against Guddu and there is no specific allegation of committing any overt act against the petitioners.
6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
7. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Manjhi P.S. Case No. 71 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
