JUSTICE BIRENDRA KUMAR ORAL ORDER 02-03-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. The F.I.R. was lodged after notice of the dead-body of Santosh Kumar whose murder was committed by causing firearm injury. On suspicion four persons are named in the F.I.R. and some unknown persons are also there. The petitioners are not named in the F.I.R.

Considering the facts aforesaid, let the petitioners, above named, in the event of their arrest or surrender before the

Patna High Court Cr.Misc. No.40019 of 2016 (4) dt.02-03-2017 2/2 Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Gaya/Successor Court in connection with Atri Police Station Case No.101 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
