The petitioners are in custody in connection with Special Excise Case No.221 of 2019 arising out of Dagarua P.S. Case No. 37 of 2019, registered for the offence punishable under Sections 272, 273 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioners submits that the petitioners have no criminal antecedent. Learned counsel for the petitioners further submits that in the instant case total 300 liters liquor was seized. Learned counsel for the petitioners would submit that petitioners are driver and Khalasi and they have no
Patna High Court CR. MISC. No.26713 of 2019(2) dt.23-04-2019 2/2 concern with the said seized liquor. Learned counsel for the petitioners submits that petitioners are in custody since 10.03.2019.
Considering the fact that petitioners have no criminal antecedent, the Court is inclined to grant bail to the petitioners. Let the petitioners named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned A.D.J.
