2. The petitioner apprehends his arrest in connection with Pipra P.S. Case No. 348 of 2024, instituted under Sections 323, 341, 342, 354B, 506, 120B of the Indian Penal Code as well as Sections 25(1-b)a and 26 of Arms Act.
3. As per the prosecution case, earlier co-accused Rita Devi in connivance with the petitioner had lodged false F.I.R. bearing Pipra P.S. Case No. 330 of 2023 against Jai Krishna Kumar which was found false after investigation. Thereafter, the present case has been lodged for commission of conspiracy and for lodging false F.I.R. against Jai Krishna Kumar.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this
Patna High Court CR. MISC. No.26495 of 2025(3) dt.20-05-2025 2/2 case. Petitioner has no concern with co-accused, Rita Devi, and Jai Krishna Kumar. No case is made out against the petitioner. There is no recovery of any incriminating material against the petitioner. He has no criminal antecedent. He undertakes to cooperate in the investigation and trial.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Supaul in connection with Pipra P.S. Case No. 348 of 2024, subject to the conditions laid down in Section 482 (2) of the Bharatiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023. (Sunil Dutta Mishra, J.) rakhi U T
