Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

This application for anticipatory bail arises out of Chakia P.S. Case No. 115 of 2020 for the offence punishable under Sections 188, 269, 270 & 271 of the Indian Penal Code; under Section 3 of the epidemic Disease Act and under Section 51 of the Disaster Management Act.

Allegation has been made that the petitioner was involved in black-marketing of oxygen cylinder when people were dying of COVID-19 pandemic.

Considering the fact that the petitioner is named in the self-inculpatory statement of co-accused, I am not inclined

The petitioner is directed to surrender in the Court below within two weeks from today. If he does not surrender within the aforesaid period of two weeks, the Superintendent of Police, East Champaran shall take all coercive steps for arresting the petitioner within next two weeks. Office is directed to send a copy of this order to the Superintendent of Police, East Champaran at Motihari through FAX or e-mail.

Sri Jharkhandi Upadhyay, learned APP for the State will also communicate this order to the Superintendent of Police, East Champaran at Motihari.
