The petitioner apprehends his arrest in Ara Rail P.S. case No. 13 of 2016 under Section 379/34 of the Indian Penal Code.

The informant lodged the case against unknown for theft of her trolley bag containing ornaments and other articles. The learned counsel for the petitioner submits that petitioner is not named in the FIR. One Manoj Dom was arrested and he confessed his guilt. Manoj Dom disclosed that he sold the ornaments to the petitioner on consideration of Rs. 50,000/- but there is no recovery of stolen articles from the possession of the petitioner. The petitioner had altercation with the accused before the occurrence. The witnesses have stated these facts during the

Patna High Court Cr.Misc. No.39987 of 2016 (3) dt.17-10-2016 2/2 course of investigation.

Considering the facts aforesaid and the fact that no stolen article is recovered from the possession of the petitioner , the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Ara in Ara Rail P.S. Case No. 13 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
