Patna High Court CWJC No.9950 of 2024(2) dt.29-07-2024 2/3 Respondent authorities to cancel/ dismiss the employment of Respondent No. 10 as Handling Labour at F.C.I. godown, Gaya as his appointment was false which was based upon forged documents regarding the name of his father and his educational qualifications where after the voluntary retirement of one Nanku Paswan @ Nanhak Paswan @ Nanhaku Paswan @ Nanhak Ram on medical grounds he is working on his place saying himself to be the son of that Nanku Paswan, as a matter of fact Respondent No. 10 is the grandson of Nanku Paswan where his real father's name is Surendra Ram where Nanku Paswan has only two sons, namely Surendra Ram @ Surendra Paswan and Mahendra Paswan (father of the Petitioner). And/or (ii).

For issuance of further order(s) / direction(s) or writ(s) in the nature of Mandamus directing the Respondent authorities to appoint either of the two sons of Nanku Ram namely Surendra Ram @ Surendra Paswan or Mahendra Paswan in his place. And/or (iii). For issuance of further order(s) / direction(s) or writ(s) in the nature of Certiorari for recovering the salary and other allowances which Respondent No. 10 has drawn till the date of disposal of this writ application after getting appointed illegally by way of committing fraud & forgery."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law. Liberty, so sought, is granted.
