JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 04-08-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. Learned counsel for the petitioner undertakes to remove the defects within three weeks of resumption of normal court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
Vide order dated 10.02.2021, petitioner was granted bail with direction to the learned court below to verify the criminal antecedent of the petitioner and if there is no criminal antecedent, petitioner should be released on bail. Learned counsel for the petitioner submits that inadvertently in the main bail application, pairvikar of the petitioner informed to the counsel that the petitioner has got no
Patna High Court CR. MISC. No.39532 of 2021(2) dt.04-08-2021 2/2 criminal antecedent but after verification it is found that the petitioner has got one criminal antecedent being Aurai P.S. Case No. 257 of 2019, registered under Sections 363, 366(A) /34 of the Indian Penal Code.
Taking into consideration the facts aforesaid, this Court is not inclined to modify the order dated 10.02.2021 passed in Cr. Misc. No. 39774 of 2020.
Accordingly, this modification application is dismissed.
