2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 30(a) and 32 of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 36 litres of illicit country made liquor has been recovered from a Toto.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. Nothing has been recovered from the conscious possession of the petitioner and petitioner has no concern with the alleged recovery.

5. Learned APP for the State has opposed the bail

Patna High Court CR. MISC. No.28358 of 2025(2) dt.14-05-2025 2/2 petition and submits that petitioner is the owner of the Toto in question.

6. Considering the quantity of recovery and the fact that petitioner is registered owner of the Toto in question from which the said recovery has been effected, the prayer for anticipatory bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Shahnawaz/- U T
