JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. It is informed that petitioner no. 1 died while he was in custody and his prayer for bail has become infructuous. So far as petitioner no. 2 is concerned, he was working as Khalsi with petitioner no. 1 and nothing was recovered from his conscious possession. It is further submitted that petitioner no. 2 does not have any criminal antecedent and, as a matter of fact, he was found sitting along with petitioner no. 1 in so called stolen pickup-van. In view of the aforesaid submission, the prayer for bail of the petitioner no. 1 stands dismissed having become

Patna High Court Cr.Misc. No.45935 of 2016 (4) dt.01-12-2016 2/2 infructuous. So far as petitioner no. 2 is concerned, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Goreyakothi P.S.Case No. 82 of 2016.
