JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 03-02-2016 In the present application under Articles 226 and 227 of the Constitution of India, the petitioners seek quashing of the FIR in Udvant Nagar P.S. Case No.442 of 2014 registered under Sections 147, 323, 384, 420, 406, 467, 468, 504, 379 and 120B of the Indian Penal Code.

At the outset, it has been submitted by Mr. Amresh Kumar Sinha, learned counsel for the petitioner, that during the pendency of the application the police have submitted final report finding the case to be a mistake of fact. He, therefore, seeks leave to withdraw the present application in order to seek other remedies

Patna High Court Cr. WJC No.675 of 2015 (2) dt.03-02-2016 2/2 available in law in case any adverse order is passed by the jurisdictional Magistrate on perusal of the police report submitted under section 173(2) of the Code of Criminal Procedure. Leave is granted.
