The petitioners are apprehending their arrest in connection with Bhawanipur P.S.Case no.37 of 2019 , registered for offences punishable under Sections 273 and 37(C ) of Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioners is of recovery of 10 ltrs. of liquor from each of the petitioner nos.1 to 4 and recovery of 08 ltrs. of liquor from the petitioner no.5.

Submission of the learned counsel for the petitioners is that the houses of the petitioners are joint with the other family members and there is no recovery from their conscious

Patna High Court CR. MISC. No.26498 of 2019(2) dt.23-04-2019 2/2 possession. They have no criminal antecedent and they are ready to abide by any condition imposed upon them. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge-cum-Spl. Judge Excise, Purnea in connection with Bhawanipur P.S.Case No.37 of 2019 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that if his actively involvement is found in such type of cases, the prosecution shall move for cancellation of the bail bond before the learned court below itself.

Let a copy of the order be sent to the S.P., Purnea also. With the aforesaid observation, this application is allowed.
