The petitioner seeks bail in Bagha P.S. Case No. 515 of 2020, registered for the offence punishable under Sections 401, 404 of the Indian Penal Code.

As per the prosecution case, two persons came on a motorcycle and after seeing the police party started fleeing away. One of them namely, Deepak Kumar was apprehended by the police who disclosed name of this petitioner as the person who fled away. He further disclosed the name of other coaccused persons including the petitioner who are engaged in selling of stolen motorcycle.

It is submitted on behalf of the petitioner that name of this petitioner has come in this case on the basis of apprehended co-accused Deepak Kumar. No incriminating article has been

Patna High Court CR. MISC. No.42200 of 2021(2) dt.03-01-2022 2/2 recovered from possession of this petitioner. Save and except disclosure there is no material against this petitioner. Petitioner claims clean antecedent and he is in custody since 07.10.2020. Chargesheet has already been submitted.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Bagaha, West Champaran in connection with Bagha P.S. Case No. 515 of 2020.
